Right of withdrawal for sole traders
When a sole trader may withdraw from a reactive.chat contract within 14 days under Polish law, how to do it, the model form, what is refunded and when the right expires.
Information under the Polish Consumer Rights Act of 30 May 2014 (ustawa o prawach konsumenta, "CRA") for natural persons running a sole proprietorship who enjoy consumer protection.
In short. reactive.chat is a service for businesses. If you are a sole trader and the contract is not of a professional nature for you, you may nevertheless withdraw from it within 14 days without giving reasons. Because our checkout does not yet ask you to request an immediate start, you then pay nothing for the time before your withdrawal: we refund everything you paid.
1. Who has this right
Consumers cannot conclude a contract for reactive.chat; the Service is offered to businesses only (see the Terms of Service).
Sole traders with consumer protection. Under Article 38a CRA the rules on the right of withdrawal also apply to a natural person who concludes a contract directly connected with their business activity where the content of the contract shows that it is not of a professional nature for that person, in particular in the light of the subject of their business activity recorded in the Central Register and Information on Economic Activity (CEIDG). Three conditions must therefore be met:
- you are a natural person running a business entered in CEIDG (not a company, partnership, foundation or association);
- you conclude the contract for that business;
- for you the contract is not of a professional nature – typically because a live-chat service lies outside the activities recorded for you in CEIDG.
Everybody else – companies, partnerships and sole traders for whom the contract is of a professional nature – has no right of withdrawal. They can end the contract by termination (section 8).
How we find out. Our registration does not ask whether you are a sole trader or what your business is, so we cannot tell from your account whether this right applies to you. The registration form points to this right beneath the checkbox by which you declare that you register as a business, and asks you to tell us at contact@lukaswojcik.com if it applies to you. If you believe it does, say so in your withdrawal. We then check the activities recorded for you in CEIDG. In case of doubt we decide in your favour.
2. Which contract you can withdraw from
You conclude a contract with us twice, in different ways:
- Registration creates the contract for the free plan. It costs nothing. You may withdraw from it under this page, but you can also simply delete your account at any time (see Access and deletion).
- Ordering a paid plan in the dashboard (Billing) concludes the contract for that plan. This is where withdrawal matters, because you have paid.
The renewal of a running subscription – from one month or one year to the next – does not open a new withdrawal period; it is the same continuing contract. A change to another paid plan concluded as a new order does open one for that order.
3. Withdrawal period
The period is 14 days from the day the contract is concluded (Articles 27 and 28 CRA). For a paid plan, the contract is concluded when your payment has been confirmed and the plan is activated in your workspace; the confirmation from our payment provider Stripe and the invoice in the dashboard show that day.
To meet the deadline it is sufficient to send your statement before the period expires. It does not matter when it reaches us.
If we failed to inform you of the right of withdrawal, the period ends twelve months after the end of the original 14 days; if we inform you within those twelve months, it ends 14 days after you receive the information (Article 29 CRA).
4. How to withdraw
Withdrawal requires no particular form and no reason. An unequivocal statement that you withdraw from the contract is enough. You may use the model form in section 5, but you do not have to.
- e-mail to contact@lukaswojcik.com – the simplest route;
- the support form: Open the support form;
- letter to LW IT Solutions Company Lukas Wójcik, al. Tadeusza Kościuszki 80/82, lok. 301, 90-437 Łódź, Poland.
Please state the e-mail address of your account and, if you have several, the workspace concerned; this lets us find the contract without further questions. We confirm receipt of your withdrawal without delay on a durable medium, normally by e-mail (Article 30(3) CRA).
5. Model withdrawal form
You may use the text below. It follows the statutory model (Annex 2 to the CRA). Fill it in and send it only if you wish to withdraw from the contract.
- To: LW IT Solutions Company Lukas Wójcik, al. Tadeusza Kościuszki 80/82, lok. 301, 90-437 Łódź, Poland, contact@lukaswojcik.com
- I/We() hereby give notice that I/we() withdraw from my/our(*) contract for the supply of the following service: reactive.chat, plan: ____________________
- Ordered on / received on(*): ____________________
- Name of the sole trader: ____________________
- Address: ____________________
- NIP (tax identification number), to check the CEIDG entry: ____________________
- E-mail address of the account and name of the workspace: ____________________
- Signature (only if this form is sent on paper): ____________________
- Date: ____________________
(*) Delete as appropriate.
6. Effects of withdrawal
The contract is treated as not concluded (Article 31 CRA).
Refund. We refund all payments received from you for the contract without delay, and at the latest within 14 days of the day your statement reached us (Article 32 CRA). We use the same means of payment you used, through Stripe, unless you expressly agree to another one; you incur no fees as a result. How long your bank takes to credit the amount is outside our control.
Nothing is deducted for the time used. Under Article 35 CRA a trader may charge for the service supplied before a withdrawal only if the customer expressly requested that the service begin before the end of the withdrawal period. Our checkout activates the paid plan at once but does not yet ask for that express request. We therefore charge nothing for the time before your withdrawal (Article 36 CRA) and refund the full amount.
Your account and data. Withdrawal ends the paid plan; we cancel the subscription with Stripe. Your workspace then continues on the free plan, exactly as at the end of any subscription: nothing is deleted, and from then on the limits of the free plan apply, for example the shorter retention of attachments sent by visitors (7 days instead of 90). If you also want your data deleted, delete the workspace or your account, or tell us in your withdrawal; how this works is described in Access and deletion. Please export beforehand whatever you want to keep.
Withdrawal from the free contract ends the contract for the free plan. We then delete your account as on any account deletion; tell us if you want it deleted at once rather than after the usual 30-day grace period.
7. When the right of withdrawal expires
For services, the right of withdrawal expires once the service has been performed in full, but only where the customer expressly requested performance before the end of the withdrawal period and was told that the right would be lost once the service had been fully performed (Article 38(1)(1) CRA).
Our checkout does not ask for that request. The right therefore does not expire early: you can exercise it throughout the 14 days, whatever you have done with the Service in the meantime. Using the Service, embedding the widget or holding conversations does not take it away.
8. Withdrawal and termination are two different things
- Withdrawal: only for sole traders with consumer protection; only within 14 days of conclusion; retroactive, with a full refund (section 6); no reason needed.
- Termination: open to every Customer at any time, in the dashboard under Billing or by e-mail; takes effect at the end of the current billing period; the current period stays paid, except as provided in the Terms of Service; no reason needed.
If you are unsure which applies, write to us and say that you want to withdraw. If the right of withdrawal does not apply, we treat your message as a termination at the earliest possible date, and tell you so.
9. Further rights and disputes
Sole traders with consumer protection also keep, among other things, the rights where a digital service does not conform with the contract and the protection against unfair contract terms (Articles 385^5, 556^4 and 576^5 of the Civil Code; Article 7aa CRA). These rights are not affected by this page; the Terms of Service describe them in the section on sole traders.
Please complain to us first: the route and the deadlines are on the Complaints page, which also lists the out-of-court routes that may be open to you. The European Online Dispute Resolution platform ceased operation on 20 July 2025 and is no longer available.
